The Lord has decided rightfully and Syed Akbar Abbas has now been placed as a New Mutwalli in place of Syed Asghar Abbas who was died a day before the last Muharram. The one who was wrongfully & purposely denied the Official Will ( Wassiyat ) of our parents. Syed Akbar Abbas has taken the charge of new Mutwalli temporarily as he is defending the case of his parent’s will in relation to the Mutwalli Ship of this Imambargah, which is under process in the civil court of Lahore District. The Mutwali ship will be handed over to the real Mutwallia Syeda Anjuman Ara after the decission of the said court for the lawfull Mutwallies. Till the decession of the court Syed Akbar Abbas will act as a Mutwalli with his elder brother Syed Raza Abbas Bokhari.

Fatwa issued No: 249 / 08 dated 17-04-2008

The above fatwas were requested from the office of Allama Sajid Naqvi in Rawalpindi and were issued in favor of Syed Akbar Abbas S / O Syed Amjad Hussain against those brothers, who are developing fuss and creating mischief for the said Imambargah and have registered some false and baseless cases against their own brothers / sister. Therefore, it is requested to every one related to this family that please don’t develop any further misunderstandings against the Wassiyat of our parents in relation to this Imambargah.

All brothers or sisters from the house of Syed Amjad Hussain Bokhari S / O Syed Inayat Ali Shah of 11-Qazilbash Road, Bibi Pakdaman, Lahore Pakistan, if disagreed or refused to accept the written wassiyat of their father & mother available, considered automatically as wicked and a convicted one under the said Shariah Law, for which a sentence is swear. Whereas, in the Law of Moses there is a death sentence in this case.

It is very important to mention here that there is a new evidence, which disclosed that the property of this Imambargah is still a joint property of all the sisters and brothers, since it has not been transferred in our father’s name and still existing in the name of our grnad Mum Syeda Marriyam Bibi W/ O Syed Inayat Ali Shah which is our inheritance and according to the law of inherited property the said deed namely Waqaf Nama of 30-4-1975 made in favor of sons ( for Oulad-e-narina ) deleting the daughters, itself a contradicted document and wrong in the eyes of law.

Without any written consent from all the inheritors including sisters / daughters of Syed Amjad Hussain it can not be registered. Therefore, every paper or document used in this context till now stands a bogus submission / unacceptable document in the Law of inheritance as well as under the Shariah Law.

It has been disclosed that the property of the above Imambargah Bibi Marriam Bibi of 11-Qazalbash Road, Bibi Pakdaman – Lahore, has not been transferred from the name of our grand Mum Syeda Marriyam Bibi till now. Therefore, the said part of the property is now as an inheritance of all sisters & brothers alive in this time. Previous Mutwali Ships will stand cancelled as the said documents were not signed by the registered owners of this portion.

Now we are it’s true inheritors and therefore, every one of us is it’s owner. If the said portion of the property will be surrendered by all of us in the name of this Imambargah Syeda Marriyam Bibi, then every one of us will be it‘s official Mutwalli equally. The said issue will be raised in the next hearing of the court to fulfill it’s legal position. Any how the official Will / Wasiyat of our parents is still stands.

And according to that Wassiyat / Official Will, Mutwalliyah Syeda Anjuman Ara has the right to have one brother out of our brothers to assist her. Whereas, all the brothers and sisters are bound to accept it in the law of Shariah Ordinance available in Pakistan, as it is a joint Official Will of our parents regarding Mutwalli Ship ( Al – Hamdullilah ), till the new official document could be registered accordingly to fulfill the legal requirements in the office of Registrar of the properties, Lahore- Pakistan.

1st of October 2009, next hearing date has been fixed in the civil case against brothers and sister by Syed Abid Abbas & Syed Asghar Abbas Bokharii. Hadi Abbas was present in the court and has clearly opposed the version of these two brothers in the court.

There is no compromise in between us because Syed Asghar Abbas Bokhari has already violated the said documents which was written for mutual compromise. The court was agreed with the views of Syed Hadi Abbas Bokhari on behalf of other brothers and sisters against Syed Abid Abbas & Syed Asghar Abbas. Next hearing in this case will be held on 1st of October 2009.

Two of our brother Syed Asghar Abbas and Syed Abid Abbas had already withdrawn themselves from the compromise which they have done by with other brothers and sisters. After the said compromise they had registered further civil cases against the rest of brothers and a sister. But now we congratulate to Syed Akbar Abbas Bokhari who got dismissal of the case in his favor registered by Syed Asghar Abbas Bokhari with misunderstandings with the help of three false and fabulous witnesses Syed Abid Abbas, Syed Iftikhar Hussain and Syed Shehr Yar Hussain, using this website under the act of cyber crime in FIA in Rawalpindi.

It is a great success for Syed Akbar Abbas Bokhari from His Lord in relation to his struggle against the false accusations from these brothers on account of Wasiat ( official will ) and the said Website of this Imambara. Masha-Allah.

Syed Abid Abbas Bokhari and Syed Asghar Abbas Bokhari had already accepted the Wasiat of our parents as an original document. These above two brothers had accepted it in writing signed by each of them and dully attested / registered by the notary Public in Lahore. It is very important to note that this is the same Wasiyat nama ( official Will ) for which Syed Akbar Abbas Bokhari was fighting for it‘s implementation being a true document of Will ( Wasiyat ) of his parents from long time. Whilst, these two brothers Syed Asghar Abbas Bokhari & Syed Abis Abbas Bokhari were falsely accusing to Syed Akbar Abbas Bokhari for forging it & prepared by himself during his long stay of 10 years of UK, even they had given oath statements falsely in the court of Law, civil court Lahore, which is still pending for decision in near future.
